Client Service Agreement Form

This Agreement by and between , (hereinafter referred to as CLIENT) and Miclyn Literary Service, (hereinafter referred to as MICHELLE FITZPATRICK) on this day of , 20.

Client Agreement

CLIENT retains all rights to any chapbook, manuscript or any other material written that is submitted to MICHELLE FITZPATRICK. CLIENT agrees to the following by initialing beside each agreement as follows:

01) CLIENT is legally responsible for the content of any written material.

02) CLIENT agrees to NOT hold MICHELLE FITZPATRICK responsible for delays or errors caused by other companies and/or distributors outside of MICHELLE FITZPATRICK's control.

03) CLIENT agrees to maintain himself/herself as the sole owner of any material submitted and agrees to full authority of any and all material.

04) CLIENT agrees to be held responsible for any written material that infringes upon any other copyrighted material, violates anyone else's right, or contains unlawful or libelous material.

05) CLIENT agrees not to hold MICHELLE FITZPATRICK responsible for any lost, stolen, or damaged postal mail caused by any carelessness of any postal employee.

06) CLIENT fully understands that this Agreement is made between the CLIENT and MICHELLE FITZPATRICK.

07) CLIENT agrees to pay MICHELLE FITZPATRICK either a downpayment--at her price--and make payments on or for the remaining balance, or in full made out to MICHELLE FITZPATRICK payable only in US FUNDS.

Michelle Fitzpatrick Agreement

MICHELLE FITZPATRICK retains only the nonexclusive right to promote, publicize, print and sell any book, manuscript or other written material submitted to MICHELLE FITZPATRICK until either CLIENT or MICHELLE FITZPATRICK decides to withdraw from this agreement by a withdrawal signature, or by means that CLIENT fails to provide payment in full to MICHELLE FITZPATRICK.

01) MICHELLE FITZPATRICK agrees to work with the CLIENT in creating and preparing any written material for the service(s) the CLIENT specifies.

02) MICHELLE FITZPATRICK agrees not to collect any money from any direct sales of any book, manuscript or other written material, with the exception of a request by the CLIENT or for payment towards any service(s) provided.

03) MICHELLE FITZPATRICK agrees to accept payment either by cash, check, money order, or paypal (if agreed upon), from CLIENT for any and all services provided.

04) MICHELLE FITZPATRICK will grant the CLIENT the right to terminate this agreement in writing at any time.

05) MICHELLE FITZPATRICK will have the right to cancel this agreement at any time, and MICHELLE FITZPATRICK will provide any refund for services not yet completed to the CLIENT by a certain date, with the exception of chapbook printing layout fees.

By printing, signing, and dating below, you, the CLIENT, agree to the information listed above.

If submitting this Agreement via email, please type your initials next to each agreement number (as stated above) as the CLIENT and type your full name twice in the signature boxes below under Client Printed Name and Client Signature, along with today's date.
